1. scope of application and general information
1.1 Subject to individual arrangements and agreements, which shall take precedence over these GTC, the following General Terms and Conditions shall apply exclusively to the business relationship between the Provider and the Customer in the version valid at the time of the order. Conflicting terms and conditions of the customer shall expressly not apply unless the provider expressly agrees to their validity in writing.
1.2 The customer is a consumer insofar as the purpose of the ordered goods and services cannot be attributed to his commercial or independent professional activity. In contrast, an entrepreneur is any natural or legal person or partnership with legal capacity that is acting in the exercise of its commercial or independent professional activity when concluding the contract.
2. offers
Our offers are non-binding. The last offer cancels all previous offers. Due to the limited quantities of individual vintages, a sell-out situation may occur during your order. If an item is not available, we will inform you within 24 hours of your order and will not invoice the ordered item.
3. payment
We accept payment in advance to our bank account, bank transfer by credit card and cash, credit card and debit card on collection.

Our prices are ex-farm prices in euros per bottle, including all statutory duties and taxes, but excluding transportation costs, which must be paid separately. Please refer to the following table for details of delivery costs:
Austria:
DPD - shipping costs 9 Euro per 12 bottles or 7 Euro per 6 bottles
Germany:
DPD - shipping costs 16 euros per 12 bottles or 14 euros per 6 bottles
Other countries:

5. delivery
5.1 The subject matter of the contract is the goods and services specified by the customer in the order and stated in the order and/or order confirmation at the final prices stated in the webshop. Errors and mistakes are reserved, in particular with regard to the availability of goods.
5.2 The quality of the ordered goods is determined by the product descriptions in the webshop. Illustrations on the website may not accurately reflect the products; in particular, colors and vintages may vary considerably for technical reasons. Images are for illustrative purposes only and may differ from the product.
5.3 If no copies of the product selected by the customer are available at the time of the customer's order, the supplier shall inform the customer of this in the order confirmation. If the product is permanently unavailable, the supplier shall refrain from issuing a declaration of acceptance. In this case, a contract is not concluded.
5.4 If the product designated by the customer in the order is only temporarily unavailable, the supplier will generally inform the customer of this on the following working day.
5.5 For logistical reasons, bottles are only shipped in boxes of 6 or 12 bottles.
5.6 We usually process your order on the following working day and dispatch it on the 3rd following working day at the latest. Should this be delayed, we will inform you by e-mail of the reason and the expected duration.
6. protection of minors
6.1 Wine may only be sold and delivered to persons over the age of 18. In order to comply with legal regulations, the supplier is entitled to hand over goods only after legitimation by an official photo ID. In the event of a justified refusal to hand over the goods, the customer is obliged to compensate for the actual damage incurred (e.g. delivery costs).
6.2 By placing the order, the customer assures that he or the recipient of the goods is over 18 years of age.
7. warranty
7.1 A warranty claim is in any case limited to the purchase price of the delivered and defective goods.
7.2 Deviations in quality, quantity, color, size, weight, equipment or design for reasons of taste, customary in the trade or minor deviations for technical reasons shall not constitute warranty defects or non-performance of the contract.
7.3 After tasting, consumption or commenced processing or treatment of the goods, any warranty is excluded.
7.4 Warranty claims presuppose that defects are reported immediately, namely recognizable defects immediately upon acceptance, hidden defects after discovery, and with presentation of the opened goods and original invoice.
7.5 The warranty period is 1 year from the date of purchase.
7.6 The Supplier shall not be liable for conformity of taste, color, material and sample or other characteristics of conformity of goods ordered subsequently. The same applies to goods ordered by sample, provided that the deviation is within customary commercial and technical limits.
7.7 The Vendor shall fulfill its warranty obligations either by delivering goods free of defects, making improvements, delivering missing goods or rescinding the contract (i.e. repayment of the purchase price) within a reasonable period of time.
